Company Information and Scope
These Terms and Conditions (“Terms”) govern the use of the online store available at www.rackun.eu (the “Website”) and apply to all purchases made through the Website.
The Website is owned and operated by Andrej Rakun s.p. (hereinafter referred to as the “Seller”, “Company”, or “Provider”).
These Terms are drafted in accordance with applicable European Union consumer protection legislation, including Directive 2011/83/EU, Regulation (EU) 524/2013, GDPR, and Slovenian law where applicable.
By placing an order, the customer (“Customer” or “Consumer”) confirms acceptance of these Terms.
Product Compliance and Warranty
The Seller guarantees that all goods are in conformity with the contract in accordance with the Consumer Protection Act (ZVPot-1).
Products are covered by a warranty ensuring proper functioning. In the event of a defect, the customer may submit a claim in accordance with applicable consumer protection legislation. Information regarding the complaint procedure is available on the website.
Ordering Process
Orders can be placed 24/7 via the Internet through the Online Store. The ordering process is available in the English language.
Customers may select products from the available product list. If a desired product is not available, customers may contact us at rackun.bike@gmail.com, and we will inform them about possible availability.
Products are delivered by post unless the customer selects personal collection at an agreed location.
Order Status
- Order Received (Unconfirmed)
After placing an order, the customer receives an automatic email confirming receipt of the order. This does not constitute acceptance of the order.
- Order Confirmed
The Provider reviews the order, verifies product availability, and either confirms or rejects the order with justification. The Provider may contact the customer by phone or e-mail to verify order details. Upon confirmation, the customer is informed by email of the estimated delivery time. At this stage, the purchase contract is concluded and binding.
- Order Shipped
The Provider dispatches the goods within the agreed timeframe and notifies the customer by email. The email includes information on returns, delivery delays, and complaint procedures.
The Seller reserves the right to change prices. In such cases, the customer will be informed by email or phone prior to order confirmation.
Purchase Without Registration
Registration is not required to place an order. This allows for a faster and simpler checkout process.
The customer receives an order confirmation email and may cancel the order until it is processed. If the order is not cancelled in time, it is considered accepted.
Registered users may benefit from additional functionalities and faster checkout.
Prices, Taxes, and Customs Duties
All prices are displayed in EUR. The Seller is not a VAT taxpayer under Slovenian law. Therefore, prices do not include VAT, and VAT is not charged or shown on invoices in accordance with Article 94 of the Slovenian Value Added Tax Act (ZDDV-1).
For deliveries outside the European Union, additional import duties, customs fees, local taxes, or other charges imposed by the destination country may apply. Such charges are not included in the price and are the sole responsibility of the Customer.
The Seller is not responsible for delays caused by customs clearance procedures.
Payment
Payment methods available to the Customer are displayed during checkout. Payment must be completed prior to shipment unless otherwise agreed.
The Customer agrees to receive the invoice electronically by email.
Delivery
Products are delivered by postal or courier services unless personal collection is agreed.
Delivery times are estimates and may vary depending on destination, carrier, and customs procedures.
The risk of loss or damage passes to the Customer upon delivery of the goods.
Warranty and Complaints
The Seller provides a warranty ensuring proper functioning of the goods in accordance with applicable law. If the Customer receives damaged or defective goods, they must notify the Seller within 8 days of receipt by email at rackun.bike@gmail.com. Only the Customer listed on the original invoice may submit a complaint.
The warranty does not apply in cases of:
- improper or negligent use,
- mechanical damage,
- unauthorized modifications or alterations,
- use of incompatible components,
- damage caused by force majeure,
- damage resulting from non-compliance with the installation instructions.
Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days from the day they acquire possession of the goods, without providing a reason. To exercise the right of withdrawal, the Customer must notify the Seller clearly and in writing:

Returns and Refunds

Return shipping costs are borne by the Customer.
The Seller may withhold the refund until the returned goods are received or until proof of return is provided. Refunds will be issued within 14 days of receiving the withdrawal notice, using the same payment method unless otherwise agreed. Returned goods must be unused, undamaged, in original packaging, and include all accompanying documentation.
The Customer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods that are: custom-made or personalized, manufactured according to the Customer’s specific instructions.
Limitation of Liability
The Seller strives to ensure accuracy of all information published on the Website. However, errors may occur. The Seller shall not be liable for indirect or consequential damages, except where liability cannot be excluded under mandatory law.
Personal Data Protection
The Seller processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable national laws. Personal data is collected and used solely for:
- order processing and delivery,
- invoicing and accounting,
- communication with customers,
- legal obligations.

The Seller does not recognize any specific alternative dispute resolution provider unless required by mandatory law.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia.
Consumers residing in the EU retain mandatory consumer protection rights under the laws of their country of residence.
Any disputes shall be subject to the jurisdiction of the competent courts in Slovenia, unless mandatory consumer protection rules provide otherwise.
Final Provisions
The Seller reserves the right to amend these Terms at any time. Changes apply only to orders placed after publication.
If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Eligibility
The sweepstakes is open to individuals worldwide unless otherwise stated. Employees of the organizer, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible. Participants must be at least 18 years old or have the legal age of consent in their country of residence.
How to Enter
To participate, entrants must follow the instructions specified for the particular sweepstakes. This may include answering a question, submitting contact information (name, surname, email), or completing a task as described in the sweepstakes announcement.
All entries must be submitted within the period stated in the sweepstakes terms. Late or incomplete entries will not be considered.
Prize Drawing and Notification
Winners will be selected randomly by a computerized draw. Only valid entries received on time and in accordance with the rules will be eligible for the draw.
Winners will be contacted by the organizer via the email address or phone number provided in their entry within 30 days of the draw.
The organizer is not responsible for undeliverable emails or incorrect contact information.
Prize Details
Prizes are non-transferable and cannot be exchanged for cash. The organizer reserves the right to substitute a prize with one of equal or greater value if the original prize is unavailable.
All prizes are awarded “as is” and without any warranty, unless explicitly stated otherwise.
Taxes and Legal Obligations
Slovenian winners:
- Prizes with a value of up to €42 are exempt from withholding tax.
- Prizes over €42 are subject to a 25% withholding tax, calculated on the prize value adjusted by a legal coefficient (1.33333). The organizer will handle the calculation and payment of this tax on behalf of the winner.
International winners:
- Winners are responsible for any taxes, duties, or other legal obligations in their country of residence.
- The organizer may request relevant documentation to comply with local tax reporting requirements.
All winners must provide accurate personal information (full name, address, and tax identification number if applicable) to ensure proper prize delivery and compliance with tax obligations.
By accepting a prize, the winner acknowledges responsibility for any applicable taxes and confirms understanding of these obligations.
Prize Delivery
Winners must provide the necessary contact details (name, surname, delivery address, phone number, email) within 30 days of being notified. Prizes will be sent via a courier service (e.g., DPD) to the address provided by the winner.
The organizer is not responsible for delivery issues caused by incorrect or incomplete information provided by the winner.
Liability
The organizer is not liable for disputes regarding prize ownership; the prize will be awarded to the person who submitted the entry. The organizer is not liable for any damage, loss, or injury resulting from acceptance or use of a prize. In the case of force majeure (e.g., natural disasters, technical failures), the organizer reserves the right to cancel or postpone the sweepstakes and will notify participants via the website or social media channels.
Rules Agreement
By participating, entrants confirm that they have read, understood, and agreed to these rules.
In the event of a conflict, these rules take precedence over any other statement or promotional material.
Personal Data
Participants consent to the organizer collecting, storing, and processing their personal data for the purpose of administering the sweepstakes in accordance with Slovenian Personal Data Protection Act (ZVOP-2) and EU GDPR.
